Welcome to Maku ("we", "our", or "us"). By using the Maku mobile application ("App") or any related services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

1. Description of Service

Maku is a food product analysis application that uses artificial intelligence (AI) to analyze food packaging and provide information about ingredients, nutritional value, and suitability based on your dietary preferences and health profile.

The App processes images of food packaging using AI-powered technology to extract and analyze ingredient information. Analysis results are personalized based on your health profile settings, including allergies, dietary restrictions, and health goals.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent that you are at least 13 years old. If you are under 18, you should review these Terms with a parent or guardian.

3. User Account

When you use the App, we automatically create an account linked to your device. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Subscriptions and Payments

Maku offers both free and premium subscription plans. Premium subscriptions provide access to additional features and unlimited scans. Subscriptions are billed through the Apple App Store and are subject to Apple's terms and conditions.

• Free Plan: Limited number of daily scans with access to basic features.
• Premium Plan: Unlimited scans and full access to all features.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store account settings.

5. Data Usage

By using Maku, you consent to the following data practices:

• We process images you submit to provide ingredient analysis.
• Your scan history is stored to provide personalized recommendations and allow you to review past analyses.
• Your health profile data (allergies, dietary preferences, health conditions) is used to customize analysis results.

6. AI Disclosure

Maku uses artificial intelligence and machine learning technologies to analyze food products. While we strive for accuracy, AI-based analysis may sometimes produce incorrect or incomplete results. The quality of analysis depends on the quality and clarity of the images you provide.

7. Medical Disclaimer

IMPORTANT: The information provided by Maku is for informational purposes only and is not intended as medical advice, diagnosis, or treatment. This App does not replace professional medical consultation.

The analysis results, including assessments of dietary suitability, allergen detection, and health recommendations, are generated by AI and may contain errors. Always verify critical health information with qualified healthcare professionals before making dietary decisions, especially if you have medical conditions, severe allergies, or are taking medications.

We are not liable for any health consequences resulting from decisions made based on information provided by this App. If you have concerns about food allergies, intolerances, or other health conditions, consult a doctor or registered dietitian.

8. Prohibited Uses

You agree not to:

• Use the App in any way that could harm, disable, or impair the service or interfere with other users' access.
• Attempt to reverse engineer, decompile, or disassemble any part of the App or its underlying technology.
• Intentionally submit an excessive number of requests (spam) or attempt to overload our servers.
• Rely solely on the App's information for critical health decisions without consulting qualified professionals.
• Use the App for any unlawful purpose or in violation of any applicable laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the App will be accurate or reliable.
• The quality of any products, services, information, or other material obtained through the App will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURLY'S TECHNOLOGY TMI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App.
• Any errors, inaccuracies, or omissions in the content.
• Any decisions or actions taken based on information provided by the App.
• Any unauthorized access to or alteration of your data.

11. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Curly's technology Tmi and are protected by international copyright, trademark, and other intellectual property laws.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by other means. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
